Arbitration Fees
DCArbMed offers a quick fixed cost arbitration scheme for the tech sector called TechArb50. Sole arbitrator, documents only conducted under UNCITRAL Arbitration Rules for disputes below £50,000.
Fixed fee £1,000 per party. If parties decide on a hearing there is an additional charge of £600 per party for a one day hearing.
Total number of words in a party’s submission limited to 5,000 including any annexes.
Maximum cost awards of £5,000.
Award within 30 days of final document submission or end of hearing.
The arbitration award is enforceable under the Arbitration Act 1996 in the same way as a court judgement . Unlike a UK court judgment, the award can be enforced in 160+ countries around the world including all EU countries under the 1958 New York Convention. This means post Brexit TechArb50 will be useful for disputes where one of the parties is not UK based.
Mediation Fees
The Civil Mediation Council introduced the Fixed Fee Mediation Scheme to offer parties a low cost method for resolving disputes of less than £50,000. Fees start from £75 per party for disputes below £5,000.
How does it work?
The scheme is administered by those mediators that have agreed to offer the scheme as part of their mediation practice. Parties have the right to use the CMC complaint procedure in the event they are unhappy with the mediator. Damian Croker is a member of the scheme.
